Resident fined after rogue ‘Man with a Van’ fly-tips his rubbish

A man from Holme On Spalding Moor has been fined after he hired a rogue ‘Man with a Van’, who fly-tipped his rubbish.

Thomas Mavin, of High Street, Holme On Spalding Moor, paid £130 to two men to take away a pile of wood and other waste from his home after he saw a flyer advertising a waste clearance service.

But the men ended up dumping all the waste in a layby in Little Weighton.

Mr Mavin pleaded guilty to an offence of failing in his duty of care by not checking he was using a licensed waste carrier to dispose of his waste, when he appeared at Beverley Magistrates’ Court on Wednesday 15 May.

He was fined £120 and was ordered to pay £350 costs and a £30 victim surcharge.

The court heard a streetscene enforcement officer from East Riding of Yorkshire Council found a large pile of wood, wrapping paper, boxes, scrap metal and a child’s scooter dumped in the layby in Walkington Road, Little Weighton, when he went to investigate a report of fly-tipping on 14 January this year.

Evidence was found linking the fly-tip with Mr Mavin’s address in Holme On Spalding Moor.

When interviewed by the enforcement officer, Mr Mavin admitted most of the waste found in the layby was his.

He said he had been carrying out renovations on his home and had accumulated a lot of waste, and because of space reasons he was unable to use a skip.

So instead Mr Mavin contacted a ‘waste clearance service’ which advertised on a flyer that came through his door, headed ‘A Man with a Van’.

He phoned the number and arranged for the men to come and collect his renovation waste, paying them £130.

The leaflet stated ‘Please ask for Stuart’ and included a fake waste carrier licence number – but Mr Mavin did not check the licence number or ask where his waste was going to.

East Riding of Yorkshire Council continues to remind residents of the risks of using illegal firms or individuals who advertise waste collection services, but instead fly-tip the waste they collect.

To prevent themselves becoming the victims of fly-tipping, residents are encouraged to use the council’s SCRAP Code  which advises what checks they need to make when hiring someone to take away rubbish to make sure they are genuine.

Firms operating legally will hold a waste carriers’ licence and be registered with the Environment Agency.

Paul Tripp, head of streetscene services at East Riding of Yorkshire Council, said:

“To help prevent fly-tipping, residents have a responsibility to make sure they dispose of their waste correctly and legally.
“Use our household waste and recycling sites or hire registered waste carriers who operate legally, get a receipt and take the person’s details. If not you could be left paying a large fine.”
